Terms of Service

Overview
These Terms of Service ("Terms") govern your access to and use of all websites and platforms run by the Federation of Students, University of Waterloo, operating as the Waterloo Undergraduate Student Association ("WUSA," "we," "us," or "our"), including but not limited to wusa.ca, clubs.wusa.ca, vote.wusa.ca and member.wusa.ca (collectively, the "Service"). This scope automatically extends to any future WUSA-operated sub-site or section, including any future Student Run Services or Societies sections.
Throughout these Terms, "you" refers to any user of the Service, including browsers, club members, club executives, purchasers, and contributors of content.
By accessing or using any part of the Service, you agree to be bound by these Terms, including any additional policies referenced here (such as our Privacy Policy). If you do not agree, you may not access or use the Service.
We may update these Terms at any time by posting changes to this page. Your continued use of the Service after changes are posted constitutes acceptance of those changes.
Section 1 – Eligibility
By using the Service, you represent that you are at least the age of majority in the Province of Ontario (18 years of age), or that you have the consent of a parent or guardian to use the Service.
Certain features (such as starting or leading a club) may have additional eligibility requirements – for example, current University of Waterloo student status, or the minimum membership thresholds set out in the applicable WUSA policy or manual (such as the Clubs Manual).
Section 2 – Accounts and Sign-In
Access to wusa.ca, clubs.wusa.ca, vote.wusa.ca and member.wusa.ca dashboard features require signing in through University of Waterloo Single Sign-On (SSO). You are responsible for maintaining the confidentiality of your UW credentials and for all activity that occurs under your account.
Section 3 – General Conduct
You may not use the Service:
(a) for any unlawful purpose; (b) to violate any applicable federal, provincial, or municipal law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame, or discriminate against any person on any protected ground; (e) to submit false or misleading information; (f) to upload or transmit malicious code; (g) to collect or track the personal information of others without authorization; (h) to spam, phish, or scrape the Service; or (i) to interfere with or circumvent the security of the Service.
We reserve the right to refuse, suspend, or terminate your access for violating any of the above.
Section 4 – Club, Service, and Society Participation
Clubs, Student Run Services, and (where applicable) Societies operating on our platforms are subject to their own operational requirements as set out in the applicable WUSA manual or policy currently in effect (such as the Clubs Manual), including but not limited to:
- Minimum membership requirements and the proportion of members who must be current University of Waterloo students
- Requirements for executives, presidents, and signing authorities
- Term acknowledgement and activity reporting obligations
- Financial processes, including reimbursement/cheque request submission and review by signing authorities
These Terms govern your general use of the Service; where a specific WUSA manual or policy conflicts with these Terms on an operational matter specific to clubs, services, or societies, that manual or policy governs for that matter.
Section 5 – Purchases and Payments
Certain products and services (such as event tickets, digital products, or memberships) may be purchased through the Service. Payments are processed by our payment processor, Moneris, through a secure, encrypted form. WUSA does not receive or store your full payment card information.
Prices, availability, and product descriptions are subject to change without notice. We reserve the right to limit or refuse any order, and to correct pricing or descriptive errors at any time.
Refunds are handled according to the refund policy applicable to your purchase (which may be a club-specific policy or WUSA's general default policy), disclosed at checkout or on request.
Section 6 – User Content and Submissions
If you submit content to us – including club descriptions, event details, comments, photos, logos, receipts, or other materials ("Content") – you agree that:
- You own the Content or have the right to submit it, and it does not infringe any third party's rights
- Your Content will not be unlawful, defamatory, abusive, obscene, or otherwise objectionable
- We may use, reproduce, and display your Content in connection with operating the Service (for example, displaying a club's description or photo on its profile page)
We may, but are not obligated to, monitor, edit, or remove Content that we determine, in our sole discretion, violates these Terms or applicable law.
Section 7 – SMS Communications
If you opt in to the WUSA SMS Service, message frequency will vary based on your usage and may include operational communications or system notifications. You may opt out at any time by replying STOP, and opt back in by replying START. See our Privacy Policy for how we handle SMS-related data.
Section 8 – Third-Party Tools and Links
The Service may link to, or provide access to, third-party websites or tools (such as payment processors, analytics providers, or external resources) that we do not control. We are not responsible for the content, accuracy, or practices of any third-party site or tool, and your use of them is at your own risk and subject to their own terms and policies.
Section 9 – Intellectual Property
All content on the Service that is created by or on behalf of WUSA (including the WUSA name, logo, and platform design) is owned by WUSA or its licensors and may not be reproduced, copied, or used without our express written permission, except as necessary for your ordinary use of the Service (e.g., viewing a club's public page).
Section 10 – Accessibility
WUSA is committed to complying with the Accessibility for Ontarians with Disabilities Act (AODA) across our digital properties, including in how we present and collect information described regarding this Service.
Section 11 – Disclaimer of Warranties; Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.
To the fullest extent permitted by law, WUSA, its directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.
Section 12 – Indemnification
You agree to indemnify and hold harmless WUSA, its directors, officers, employees, volunteers, and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.
Section 13 – Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms. Provisions that by their nature should survive termination (such as intellectual property, indemnification, and limitation of liability) will survive.
Section 14 – Governing Law
These Terms are governed by, and will be construed in accordance with, the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Waterloo Region, Ontario.
Section 15 – Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
Section 16 – Entire Agreement
These Terms, together with our Privacy Policy and any policy or manual referenced herein, constitute the entire agreement between you and WUSA regarding the Service, superseding any prior agreements or communications.
Section 17 – Changes to These Terms
We may update these Terms at any time by posting the revised version to this page. It is your responsibility to review these Terms periodically. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
